I regularly wear between 8 and 8.5 depending upon brand. The 40 is just slightly too big and one size lower was just slightly too small. I kept the 40, but would be happier with a slightly smaller size. The foot bed on the 40 was more suitable and felt right for my foot, but the length of the toe makes me trip occasionally.
